1. Acceptance of terms
By downloading, installing, or using Lumis ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of service
Lumis is a Stoic philosophy companion that provides AI-powered philosophical dialogues and reflections, guided journaling, curated Stoic content, and personalized guidance. The App uses artificial intelligence to generate philosophical responses for educational and reflective purposes only.
3. Eligibility
You must be at least 16 years of age to use Lumis. If you are under 18, you must have the consent of a parent or legal guardian.
4. Accounts
You may create an account using email and password or Sign in with Apple. You are responsible for the confidentiality of your credentials and for all activity under your account, and you agree to keep your information accurate. You may delete your account at any time in the app settings. We may suspend or terminate accounts that violate these Terms.
5. Subscriptions and payments
Lumis offers free and premium tiers; premium features require a paid subscription, which may begin with a free trial (currently 7 days). Payment is charged to your Apple ID at confirmation of purchase. Unless canceled at least 24 hours before the end of the current period, your subscription — and any free trial — automatically renews or converts to a paid subscription at the then-current price, and your Apple ID is charged for the renewal. You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID settings. Refunds are handled by Apple under their policies. We may modify pricing and will notify you before changes take effect; changes apply only at your next renewal.
6. User content
You retain ownership of all content you create within Lumis, including journal entries and conversation text ("User Content"). You grant us a limited license to store, process, and transmit your User Content solely to provide and improve the service — including sending conversation text to a trusted third-party AI provider to generate responses. You are solely responsible for what you submit and agree not to submit content that is illegal, harmful, abusive, or otherwise objectionable.
7. AI-generated content
Responses generated by the AI are for educational, philosophical, and reflective purposes only. They are not professional medical, psychological, or therapeutic advice, and are not a substitute for professional mental-health services. AI responses may contain inaccuracies; use your own judgment.

8. Acceptable use
You agree not to use the App for any unlawful purpose, attempt unauthorized access, interfere with the App's integrity or performance, reverse engineer it, use it to build a competing product, access it through automated means, share your account, or circumvent usage limits.
9. Intellectual property
The App — its design, features, code, content (excluding User Content), and branding — is owned by Lumis and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes under these Terms.
10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free availability, and we are not responsible for outages or changes caused by third-party service providers.
11. Limitation of liability
To the maximum extent permitted by law, Lumis shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or fifty US dollars ($50).
12. Indemnification
You agree to indemnify and hold harmless Lumis and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or your violation of these Terms.
13. Changes to the service and these terms
We may modify, suspend, or discontinue any part of the App at any time. We may update these Terms from time to time and will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use after changes take effect constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Disputes shall first be addressed through good-faith negotiation; if that fails, through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. Any dispute resolution will be conducted on an individual basis, not as a class or representative action.
15. Severability and entire agreement
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumis.
16. Apple App Store
These Terms are between you and Lumis only, not with Apple, and Apple is not responsible for the App or its content. Your use of the App must also comply with the App Store Terms of Service. To the extent these Terms serve as the end-user license agreement (EULA) for the App:
- · License. We grant you a non-transferable license to use the App on any Apple-branded device you own or control, as permitted by the Usage Rules in the App Store Terms.
- · Maintenance and support. We, not Apple, are solely responsible for support and maintenance; Apple has no obligation to provide any support.
- · Warranty. We are solely responsible for any product warranties. If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- · Claims. We, not Apple, are responsible for addressing claims relating to the App, including product-liability, regulatory, and consumer-protection claims.
- · Intellectual property. We, not Apple, are responsible for any third-party intellectual-property infringement claim relating to the App.
- · Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited- or restricted-party list.
- · Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
